Insurance Policy Wording and Coverage

Molly represents clients crafting insurance policy wordings and evaluating potential exposures of existing or proposed insurance products. She also supports insurers and reinsurers with their claims, providing coverage analysis in both litigated and non-litigated matters. Her experience has involved matters in a variety of areas, arising out of a number of different legal theories and factual situations, including:

  • Cybersecurity and data security
  • Privacy
  • Technology
  • Media
  • Professional liability
  • Directors and Officers liability
  • Errors and Omissions liability
  • Financial liability

She has also worked closely with third-party liability and casualty claims, including those involving catastrophic situations and those alleging bodily injury or property damage arising from long-time or latent environmental, occupational and other exposures. She has addressed first-party property damage and business interruption claims, including hurricane, mining, cargo and trucking matters. In addition, her work has encompassed extra-contractual and bad faith topics.

The matters in litigation have featured a wide variety of organizations and industries facing financial exposures of all sizes in jurisdictions throughout the United States. Her experience includes jury and bench trials and matters on appeal. Recognizing that not every matter should proceed to court or arbitration, Molly has regularly worked to resolve possible disputes without adversarial proceedings and to negotiate commercial settlements.

Cybersecurity and Privacy – Insurance Policy Wording and Coverage

Molly is dedicated to representing insurers and reinsurers in respect of cyber, technology, media, data security, professional liability, directors and officers, errors and omissions, and financial liability policies. She has provided legal advice to insurers developing or revising policy wording. She has also represented insurers in more than 1,300 first-party and third-party cybersecurity and privacy claims arising out of a number of different policy wordings, legal theories and factual situations. She frequently advises about, for example, claims concerning:

  • Incident and breach response
  • Cybersecurity and privacy liability
  • Regulatory proceedings
  • Ransomware
  • Malware
  • Extortion
  • Business email compromise
  • Wire transfer fraud
  • Business interruption or business income loss
  • Data or system restoration or replacement costs

Cybersecurity and Privacy – Risk Management

Molly also works with clients to create and implement programs and procedures for cybersecurity and privacy risk management, address regulatory and contractual requirements, engage in solid practices for third-party service provider and vendor relationships, and bolster incident preparedness and response readiness.

She is a frequently requested speaker and a prolific writer on cybersecurity, privacy and insurance topics.
