Richard Reibstein Quoted in Law360 on Mixed Results of California Trucking Industry's Effort to Continue Classifying Workers as Independent Contractors

Richard Reibstein, a Partner in Locke Lord’s Labor and Employment Practice in New York and Co-Chair of the Firm’s Independent Contractor Misclassification and Compliance Practice, was quoted in a Law360 article examining a federal district court’s rejection of arguments by California trucking companies that the state’s ABC test for distinguishing between employees and independent contractors places a burden on the motor carriers. “The transportation industry groups have been waging war for years on laws that use an ABC test to determine independent contractor status, and have obtained mixed results,” said Reibstein, adding that the trucking industry might look for another way to resolve a “split in the circuits.”
