Richard Reibstein, co-head of Locke Lord’s Independent Contractor Misclassification and Compliance Practice, was quoted by Law360 on efforts by state legislatures to make it less challenging for companies to classify workers as independent contractors. Over the past 12 months, at least eight states considered bills that would have eliminated impediments or paved the way for companies to defend their classification of workers as independent contractors. These laws tend to counteract efforts in some states to curtail the use of otherwise legitimate independent contractors.

"This has become a political issue, and I think that each state can make its determination of how vital independent contractors and small entrepreneurs are," Reibstein said.
