Locke Lord Houston Partner Ben Cowan was quoted by Law360 on key takeaways from the U.S. Environmental Protection Agency's (EPA) decision to drastically reduce its assessment of the acceptable levels of toxic "forever chemicals" that humans can healthily ingest, setting the stage for further federal and state regulatory actions. Cowan notes lawmakers have been pushing for federal action on polyfluoroalkyl substances (PFAS), and it seems the EPA is finally ready to set some firm standards soon.

“PFAS has been an issue for the last several years and we've come to understand it, but everyone's sort of been giving it the side eye — we didn't have to deal with it yet — and now what we're seeing is that EPA is getting to the point where it's starting to regulate and it's going to hit every facet of environmental law and be a significant new source of cost and technological challenge," Cowan said.
