Health Care CHOW in Bankruptcy Sales

Tammy Woffenden, Partner in Locke Lord’s Austin office, authored an article for the American Bankruptcy Institute discussing how the purchase of distressed health care businesses and bankruptcy acquisitions can trigger change of ownership (CHOW) regulations from various state and federal agencies. Woffenden explains that failure to follow such requirements could adversely impact the new owner’s post-closing operations and reimbursement.
