Houston Locke Lord Partner Gerry Pels Quoted by Law360 on Potential Effects of Fifth Circuit’s Decision for Environmental Citizen Suits

Gerry Pels, Houston Partner and Chair of the Firm-wide Environmental Section – Energy and Industry and ESG Practice, was quoted by Law360 on an upcoming Fifth Circuit decision that could change the standing test for citizen suits brought under the Clean Air Act.

“It might not be a bad thing if the Fifth Circuit issues a stricter reading of standing,” Pels said. "I think citizen suits should not be the catalyst for compliance but rather should be available in those situations where an agency … for whatever reason have not acted, or have chosen not to act.”
