Dallas and Houston Locke Lord Team Obtain Decision in Favor of Lutheran Social Services of the South

Robert Nail (Dallas) and Emma Bennett (Houston) obtained a decision in favor of Lutheran Social Services of the South (LSSS), a licensed foster care and adoption placement agency in the State of Texas, in its trademark opposition proceeding before the Trademark Trial and Appeal Board (TTAB). Under review, the TTAB held that LSSS is the exclusive owner of priority trademark rights in its federally registered mark, “UPBRING.” The Board also concluded that the goods and services offered by the opposed applicant under an identical UPBRING mark were complementary to services offered by LSSS and targeted the same customers and trade channels, noting that allowing registration of the UPBRING mark by opposed applicant would “cause a likelihood of consumer confusion,” according to the decision. The TTAB sustained the opposition to registration in favor of LSSS and denied opposed applicant’s federal trademark application for UPBRING.
