Patrick’s experience includes:

Traditional Labor

  • Provide advice and counsel on labor relations issues to clients in transportation, healthcare, retail, mining and automotive industries
  • Advise and train on union avoidance; Act as a "first responder," for petitions and campaigns
  • Defend employers and lead campaign process once petition filed
  • Represent employers against charges and litigation before the NLRB, state labor agencies
  • Represent employers at third-step grievance meetings and arbitrations
  • Represent employers in bargaining
  • Review and advise on labor issues that may arise in the course of large commercial transactions

Employment Counseling and Litigation

  • Counsel managers on compliance with federal and state employment laws. Provide advice on implementation of new policies, handbooks and human resource initiatives. Lead confidential workplace investigations. Draft and revise employee handbooks, separation agreements, non-compete/non-disclosure agreements and state-compliant employee policies. Advise employers on sensitive personnel actions and absence management under ADA/FMLA. Advise employers on compliance with Federal/State WARN responsibilities and requirements.
  • Manage all stages of the litigation process, from inception to disposition: Draft position statements, pleadings, litigation documents, discovery requests and responses, motions and briefs. Take and defend depositions. Prepare for and assist in state and federal trials. Conduct witness interviews, draft case assessments, create case budgets, analyze factual and legal issues, conduct research and provide advice, prepare motions for summary judgment and assist with mediations. Act as second-chair for state and federal trials.
