Rowe Snider, Molly McGinnis Stine and Kenneth Suh will serve as panelists at the APCIA National General Counsel Conference in Atlanta, GA on October 28, 2022. The panel will discuss “BIPA – A Four-Letter Word Triggering Nine-Figure Nightmare Settlements.”
BIPA – Illinois’ Biometric Information Privacy Act – regulates the collection, use, and handling of biometric identifiers and information by “private entities”. BIPA contains a frequently exercised private right of action. Recent court decisions affect or may affect the scope and application of the Act and may increase, possibly significantly, the potential financial exposure faced by private entities. Other states have enacted or are contemplating similar legislation, although no others as yet have a private right of action. Some private entities have sought coverage under insurance policies, including general liability and cyber policies, resulting in a small but growing number of decisions, most of which have found coverage. This session explores these trends and considers BIPA’s future.
